On Wednesday
November 13, 2002 the United States Supreme Court heard two challenges
to Megan's Law. Sex Offenders are arguing that their rights are
greater than the rights that communities have to be made aware
of their presence. The decisions of the U.S. Supreme Court will
shape the future of our nation's Megan's Law.
The
United States Justice Department has submitted two amicus briefs
(friends of the court) supporting both states in their fight to
maintain the integrity of our nation's sex offender registration
and notification laws. Alaska is being challenged on an ex post
facto argument - offenders argue that they committed their crimes
in the past and served their time and Megan's Law is additional
punishment. Connecticut sex offenders are challenging the state
on a due process issue. Sex offenders are arguing that in order
to be subjected to the highest level of notification with the
most amount of information available to the community, they must
first be given due process to determine just how much of a risk
they pose. The final decisions made by the U.S. Supreme Court
Justices will shape the future of our nation's Megan's Law. Pay
close attention.
